BPetit Terms of Service

These Terms of Service (the "Terms") are a binding legal agreement between you and Manecharo, the individual (sole proprietor) who operates BPetit (together, "BPetit", "we", "us", or "our"), and govern your access to and use of the BPetit pet-health platform, including the website at bpetit.com and the BPetit Android application (package com.bpetit.app) (together, the "Service"). Please read them carefully — they include important limitations on our liability (Sections 15–16), a section on how disputes are resolved (Section 19), and information about automatically renewing subscriptions (Section 11). These Terms are provided in English; translations, where offered, are for convenience only and the English version governs.
1. Acceptance and binding agreement
By creating an account, checking the box that confirms you agree to these Terms and our Privacy Policy, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not create an account or use the Service.
At sign-up we record the date and time of your agreement and the version identifier of the policies you accepted, so that we can ask you to review and re-accept updated terms when material changes require it. If we update these Terms in a way that requires renewed agreement, we may ask you to accept the new version before you continue using the Service (see Section 20).
2. Eligibility and 18+ requirement
The Service is intended only for individuals who are at least 18 years old. By creating an account and using the Service, you represent and warrant that you are 18 or older. During registration you must enter your date of birth; we check the date you provide in your browser and again on our servers, and accounts that do not meet the minimum age are not created. This is a self-declared age check based on the date of birth you enter — we do not verify your identity or request age documents. We do not knowingly collect information from, or provide the Service to, anyone under 18.
If we learn that an account belongs to someone under 18, we may suspend or terminate it and delete the associated data.
3. Account registration, security, and accuracy
To use most features you must register an account using a valid email address and password. Authentication and session management are handled by our infrastructure provider on our behalf; we do not store your password in plain text.
- Accuracy. You agree to provide accurate, current, and complete information at registration and to keep your profile information up to date.
- Security. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. You must notify us promptly at support@bpetit.com if you suspect any unauthorized access or use.
- One person per account. Your account is for your own use. You are responsible for the pets, records, and content you add.
4. Description of the Service
BPetit is a pet-health management platform that lets you record and organize information about your pets. Depending on your plan and the features available, the Service includes:
- Health record keeping — pet profiles, weight records, vaccinations (including reminder dates), vet visits, medications and dose tracking, and uploaded documents such as vaccination certificates, lab results, prescriptions, and insurance files.
- PetitPal AI assistant — an AI-powered assistant that answers general pet-care questions and can help generate training plans and extract medication details from text you provide.
- Community — the ability to publish posts and comments, follow pets, react ('paws'), and interact with other pet owners, subject to the profile-visibility setting you choose.
- Emergency guides — general informational content for handling pet emergencies, plus the ability to store emergency contacts for your pets.
- Lost-pet finder — tools to flag a pet as lost, generate a QR code, optionally enable microchip lookup, and receive reports from people who find your pet.
- Reminders and notifications — email and web push notifications for medications, vaccinations, and appointments, which you can control in your settings.
Some features (for example, unlimited PetitPal usage and exporting a PDF health report) require a paid subscription, as described in Section 11.
5. Important: informational only — not veterinary advice
6. Your content and license to BPetit
"Your Content" means the information and materials you submit to the Service, including pet records and health data, photos and documents, community posts and comments, messages you send to PetitPal, and similar materials.
You retain ownership of Your Content. You grant BPetit a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display Your Content solely to operate and provide the Service to you — for example, to show your posts in the community, to display limited pet information to a finder when you enable the lost-pet finder, to deliver reminders, and to generate AI responses you request. This license ends when you delete the relevant content or your account, except as described in Section 18 (survival and license wind-down) and to the extent retained copies are required by law or for security, or remain in routine backups for a limited period before being overwritten.
You are responsible for Your Content and represent that you have the rights necessary to submit it and that it does not violate these Terms or any law or third-party right.
7. Acceptable use and prohibited conduct
You agree not to misuse the Service. Without limitation, you must not:
- Post or share content that is unlawful, harmful, abusive, harassing, hateful, threatening, infringing, fraudulent, or that depicts or promotes cruelty to animals;
- Harass, threaten, impersonate, or violate the rights or privacy of others;
- Attempt to access accounts, data, or areas of the Service that are not yours, or circumvent our security, access controls, age check, usage limits, or feature gating;
- Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service or its infrastructure;
- Use the Service to provide veterinary or professional services to third parties, or in any way that relies on it as a source of professional medical advice;
- Submit false, misleading, or spam reports through the lost-pet finder or the community reporting tools;
- Use automated means to scrape, copy, or harvest data, or otherwise use the Service in violation of these Terms or applicable law.
We may take any action we reasonably consider appropriate if you violate this Section, including the moderation, suspension, and termination measures described in Sections 8, 9, and 18.
8. Community content and moderation
The community lets you publish posts and comments and interact with other users. You are solely responsible for the content you publish. Other users' content is their own, and BPetit does not endorse and is not responsible for opinions, advice, or information shared by other users.
- Automated filtering. Posts may be automatically rejected if they contain certain prohibited terms.
- Reporting. You can report posts or comments you believe violate these Terms (for example, for spam, harassment, or harmful content).
- Profile visibility. You can set your profile visibility (for example, public or private). Note that following on BPetit is pet-based — users follow pets rather than each other — so visibility settings should be understood in that context.
- Moderation rights. We reserve the right — but are not obligated — to review, flag, hide, remove, or refuse any content, and to take action on reports, at our discretion. Flagged content may be hidden from community feeds.
- Your own content. You may delete your own posts and comments at any time.
We are not obligated to monitor content and do not guarantee that all violating content will be detected or removed. Removal of content does not waive any of our other rights under these Terms.
9. Copyright and intellectual-property complaints
We respect intellectual-property rights and expect users to do the same. If you believe content on the Service infringes your copyright or other intellectual-property rights, you may send a notice to our designated agent at support@bpetit.com (subject line: "IP / DMCA Notice").
- What to include. Your notice should identify the work you claim is infringed; identify the specific content and its location on the Service (for example, a link to the post or comment) so we can find it; provide your contact details; include a statement that you have a good-faith belief the use is not authorized; and include a statement, under penalty of perjury where applicable, that the information is accurate and that you are the rights holder or authorized to act on their behalf.
- Action and counter-notice. We will review valid notices and may remove or disable access to the content. Where the law provides a counter-notice procedure (for example, under the U.S. Digital Millennium Copyright Act), the user who posted the content may submit a counter-notice using the same contact, and we will handle it in accordance with applicable law.
- Repeat infringers. We may, in appropriate circumstances and at our discretion, limit, suspend, or terminate the accounts of users who repeatedly infringe the intellectual-property rights of others.
10. Lost-pet finder
The lost-pet finder is provided to help reunite lost pets with their owners. When you flag a pet as lost or enable microchip lookup, a member of the public who finds your pet can submit a report that includes their name and contact details (phone and/or email), a free-text description of where the pet was found, and a message. These reports are delivered to you, the owner, by email and (if enabled) push notification, and are visible to you in the app.
The public lookup tools are designed to reveal only minimal information about a pet (such as its name, species, and lost status) and not your home location or private photos; the Service does not collect or display GPS coordinates of your pet, and a finder's "where found" description is free text they enter. If you submit a found-pet report as a finder, you confirm that the contact details you provide are accurate and that you consent to them being shared with the pet's owner so they can contact you.
11. PetitPal AI assistant — usage limits
PetitPal is subject to the disclaimer in Section 5 and to fair-use limits. The number of AI messages you can send within a rolling 24-hour period depends on your plan (free accounts have a lower daily limit than premium accounts), and these limits are enforced on our servers. When you reach your limit, you will be asked to wait or upgrade. Messages you send to PetitPal are processed by a third-party AI provider to generate replies and may be retained as part of your conversation history; you can delete conversations, and conversations expire automatically after a set period. Do not submit information through PetitPal that you would not want stored or processed.
12. Subscriptions, billing, auto-renewal, and refunds
Certain features require a paid subscription (the premium tier). Subscriptions are sold and processed by Paddle, our third-party payment provider, which acts as the Merchant of Record — Paddle handles the sale, processing, and billing of your subscription, and your purchase is also subject to Paddle's own terms and privacy policy. We do not collect or store your full card number or payment-method details; those are handled by Paddle. You purchase and manage premium on the BPetit website (bpetit.com). The BPetit Android app does not sell digital subscriptions through Google Play's in-app billing system; to subscribe or change your plan from a mobile device, you complete the purchase on our website, after which premium applies to your account across all your devices.
- Pricing and changes. Subscription prices and the features included in each tier may change. We will give you advance notice of a price increase that will apply to your renewals (at least 30 days, or longer where required by law), and the new price applies from your next billing cycle after the notice period; if you do not accept it, you may cancel before it takes effect.
- How to cancel. You may cancel at any time through the Paddle customer portal, which we make available from your account. To avoid the next charge, cancel before the current period ends. Cancellation generally takes effect at the end of the current billing period, and you keep premium access until then.
- Refunds. Except where a refund is required by applicable law or your statutory consumer rights (including the withdrawal right described below and in Section 19), payments are generally non-refundable, including for partial billing periods. Refunds are handled in accordance with Paddle's policies and applicable law.
Mobile app. The BPetit Android app distributed through Google Play does not sell digital subscriptions inside the app; premium is purchased on the BPetit website (bpetit.com) and then unlocked on your account on all your devices. If we ever introduce in-app purchases through Google Play's billing system, those purchases would additionally be governed by Google's terms and Google's billing, renewal, and refund processes, and we would update these Terms accordingly.
13. Third-party services
The Service relies on third-party providers to function — including our database, authentication, and storage provider; our payment provider; our AI provider; our email and push-notification delivery providers; and our hosting provider. These services are described further in our Privacy Policy. Your use of features that depend on a third party may also be subject to that third party's terms, and we are not responsible for the acts, omissions, availability, or policies of third parties. We do not control and are not responsible for third-party websites or services that may be linked from the Service.
14. Intellectual property
The Service — including its software, design, user interface, text and graphics we provide, the "BPetit" name, the PetitPal name, our logo, and our brand identity — is owned by BPetit or its licensors and is protected by intellectual-property and other laws. Except for the limited rights to use the Service granted to you under these Terms, no rights in our intellectual property are transferred to you. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the Service or our branding without our prior written permission. Your rights in Your Content are addressed in Section 6, and intellectual-property complaints are handled under Section 9.
15. Service availability and modifications
We may add, change, suspend, or discontinue any part of the Service at any time, and we may impose or change limits on features. Where a change is material and adverse to you, we will take reasonable steps to give advance notice (for example, in the app or by email). We aim for high availability but do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, and the Service may be unavailable due to maintenance, updates, third-party outages, or factors beyond our control. We are not liable for any unavailability or for any loss arising from it, except to the extent such liability cannot be excluded under applicable law.
16. Disclaimers of warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Without limiting Section 5, we make no warranty that any information provided through the Service (including PetitPal output, emergency guides, or reminders) is accurate, complete, reliable, or suitable for your situation, or that reminders and notifications will always be sent or delivered. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you, and you may have warranty or guarantee rights under the law of your country that these Terms do not affect.
17. Limitation of liability
To the maximum extent permitted by applicable law, BPetit and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service, including any reliance on information provided through it.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) USD 50.
18. Suspension and termination
You may stop using the Service at any time and may delete your account from Settings. Deleting your account removes the data associated with your account through cascading deletion and makes a best-effort removal of files you have uploaded (avatars, pet photos, documents, and community post images, including files in nested folders). Some copies may remain for a limited time in backups or where retention is required by law or for security, as described in our Privacy Policy, and information you already shared with others outside your account (for example, a found-pet report a finder has already sent you, or content others have already saved or quoted) may persist after deletion.
We may suspend or restrict your access — including for a defined period using our account-suspension mechanism — or terminate your account, if we reasonably believe you have violated these Terms, created risk or legal exposure for us or others, or if required by law. A suspended account may have limited access to the Service (for example, to view its account status) until the suspension ends or is lifted. Where reasonable and lawful, we will aim to give notice, but we may act immediately in cases of serious or ongoing violations.
Survival. Provisions that by their nature should survive termination will survive, including Sections 5, 6 (license wind-down), 9, 12 (amounts owed and refunds), 14, 16, 17, 19, 20, and 21.
19. Governing law and dispute resolution
These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of the country in which the operator of BPetit is resident or established, without regard to its conflict-of-laws rules, and the courts of that country have non-exclusive jurisdiction over such disputes — except that, if you are a consumer, you also enjoy the protection of the mandatory laws of your country of residence and may bring proceedings there. We will identify our specific governing jurisdiction in these Terms once our operating entity is finalized; until then, the consumer protections described in this Section and the mandatory law of your home country continue to apply in full.
Informal resolution first. Before starting any formal proceeding, you agree to contact us at support@bpetit.com and give us at least 30 days to try to resolve the dispute informally. Many concerns can be resolved this way.
20. Indemnification
This Section applies only if you use the Service for business or professional purposes (i.e., you are not acting as a consumer), and only to the extent permitted by applicable law. If you are a consumer, this Section does not apply to you, and nothing in these Terms requires you to indemnify us beyond what the law allows.
Subject to the above, you agree to indemnify and hold harmless BPetit and its affiliates from and against any claims, damages, liabilities, losses, and reasonable expenses (including legal fees) arising out of or related to (a) Your Content, (b) your use of the Service in violation of these Terms or applicable law, or (c) your violation of any third party's rights. This Section does not apply to the extent a claim arises from our own breach of these Terms or our negligence.
21. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and update the version identifier we record at sign-up. Where changes are material, we will take reasonable steps to notify you in advance (for example, in the app or by email) at least 30 days before they take effect (or sooner if a change is required by law or addresses a security issue), and, where appropriate or required, ask you to re-accept the updated Terms before continuing. Your continued use of the Service after an update takes effect means you accept the updated Terms. If you do not agree to the updated Terms, you should stop using the Service and may delete your account.
22. Export controls and sanctions
You may not use the Service if you are located in, or are a resident of, a country or territory subject to comprehensive government sanctions, or if you are an individual or entity on an applicable restricted-party or sanctions list. By using the Service, you represent that you are not subject to such restrictions and that you will not use the Service in violation of applicable export-control or sanctions laws.
23. General
- Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be applied to the fullest extent permitted by law.
- Entire agreement. These Terms, together with the Privacy Policy and any terms presented at purchase, are the entire agreement between you and BPetit regarding the Service and supersede any prior agreements on the subject.
- Assignment. You may not assign or transfer these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law.
- Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- No third-party beneficiaries. Except as expressly stated, these Terms do not create rights for any third party.
